An “aggressive” lawyer may take positions that are outside of a reasonable range of results. He or she may also personalize the case by making inappropriate written or oral statements about the other lawyer and his or her client. The best way to deal with this kind of tactic is be non-reactive to inappropriate criticism, to try to de-escalate conflict, to keep focused on reasonable goals, and to take the high ground throughout the process. This approach will likely lead to tangible benefits in resolving your case, whether in mediation or in trial.
